When a person is injured as a result of an assault, the incident is legally termed a “criminal injury”. In order to claim there are a number of CICA criteria that must be satisfied:
The assault must be reported to the police immediately and without delay. The value of the pain
and suffering must exceed £1,000. A claim form must be submitted within two years of the assault. RTA offences are excluded unless a vehicle is used as a weapon. The victim must have received medical attention on at least two occasions The recovery period must exceed six weeks The victim must not have provoked the assault. The claimants unspent previous convictions for violent offences are considered. There must be full co-operation by the claimant. A conviction is not necessary to claim. An offender must not benefit from an award.
